Rule 7: 2 Process

Rule 7:2-1C­ontents of Complaint, Compla­int­-Wa­rrant (CDR-2) and Summons
Analysis
Contents of Complaint, Arrest Warrant and Summons. This rule collects and restates, in full text, all the provisions addressing the required contents of the complaint and summons or warrant in non-in­dic­table matters of Part III as well as including traffic offenses. Issuance of process generally, arrest warrants and summonses are addressed by R. 7:2-2, 7:2-3, and 7:2-4 respec­tively.
Rule 7:2-2 Issuance of Compla­int­-Wa­rrant (CDR-2) or Summons
Analysis
Issuance of Arrest Warrant or Summons. This rule collects the provisions respecting the issuance of process in municipal court non-in­dic­table matters.
Rule 7:2-3 Warrants; Execution and Service; Return
Analysis
Warrants; Execution and Service: Return. This rule collects the provisions respecting the service and execution of either a bench warrant or an arrest warrant.
Rule 7:2-4 Summons; Execution and Service
Analysis
The rule makes provision for service of the summons by personal service or by ordinary mail or, if defendant does not respond to ordinary mail, then by simult­aneous ordinary and certified mail.
Rule 7:2-5 Defective Warrant or Summons; Amendment
Analysis
No person arrested under a warrant or appearing in response to a summons shall be discharged from custody or dismissed because of any technical insuff­iciency or irregu­larity in the warrant or summons, but the warrant or summons may be amended to remedy any such technical defect.
